Email and instant messaging they're great tools, but they
can cause problems.

We know for example that one in twenty employers
has had to go to court and battle a workplace lawsuit that's
triggered by employee email.

We know
that in 2003 twenty two percent of employers had employee email
subpoenas either by a court or a regulatory body. Email today
is the electronic equivalent of DNA evidence.
So in order
to get around creating a written record many people have resorted
to instant messaging, however…
Just
like email instant messaging creates a written business record
and it's really the obligation of employers to retain those
written business records. And of course you want to put a policy
in place and you want to let your employees know here are our
rules, here are our policies, here's what's allowed and here's
what's banned when it comes to instant messaging.
Sending
offensive jokes is one of the major reasons people and companies
get sued and there's another problem with instant messaging…
